RENTAL PROGRAM POLICY

The following outlines Liberty Care Mobility’s rental program, including rental terms, payment requirements, delivery areas, and equipment responsibilities. Please review carefully before proceeding with a rental.


🔹 Rental Program FAQs

1️⃣ Credit Card Requirement

A valid credit card is required and must be kept on file for all equipment rentals. Rental charges, service fees, damages, or unpaid balances will be billed to this card.


2️⃣ Delivery Area

Standard delivery is available within the following areas:

  • Mississauga

  • Oakville

  • Burlington

  • Toronto

  • Etobicoke

  • Brampton

  • Milton

  • Woodbridge

  • North York

  • Scarborough

  • Richmond Hill

Additional delivery or pickup fees may apply for locations outside these areas.


3️⃣ Rental Renewals

All rentals are set to automatically renew after the initial rental period unless a return or pickup is requested.

  • Pickup charges may apply

  • Rentals continue until proper notice is provided


4️⃣ Rent-to-Own Policy

Only the first month’s rental fee may be applied as a credit toward the full purchase price of the rented equipment. Subsequent rental payments are not eligible for purchase credit.


Equipment Rental Agreement

This Equipment Rental Agreement (“Agreement”) is entered into between Liberty Care Mobility Inc. (“Company”) and the Renter, as identified on the associated invoice and/or rental schedule.


1️⃣ Equipment Description

The rented equipment is described in the rental invoice or rental summary associated with this Agreement.


2️⃣ Payment Terms

  • A valid credit card must be provided and kept on file

  • Monthly rental fees will be automatically charged on the Recurring Payment Day of the Month, as outlined in the rental summary


3️⃣ Insufficient Funds & Service Fees

A $35 service fee will be applied to any failed or declined transaction due to insufficient funds or payment rejection.


4️⃣ Rental Term & Return Notice

  • The rental term begins on the delivery or pickup start date

  • Minimum rental terms (typically 1–2 months) apply, depending on the equipment

  • Rentals continue until the renter provides 2–3 business days’ notice to terminate the rental and arrange return or pickup

To avoid additional charges:

  • Equipment must be received by Liberty Care Mobility Inc. within 1–2 days following the scheduled recurring payment date

  • A 2-day grace period is permitted


5️⃣ Return of Equipment

Returned equipment may be arranged via pickup or drop-off.

  • Pickup fees may apply

  • Renters are strongly encouraged to insure returned equipment for its full replacement value

  • Liberty Care Mobility Inc. is not responsible for loss or damage during return transit


6️⃣ Care, Operation & Use

  • Equipment must be used with reasonable care and only for its intended purpose

  • Equipment must comply with all applicable laws and safety regulations

  • Unauthorized alterations, modifications, or misuse are strictly prohibited


7️⃣ Maintenance & Repairs

  • Normal wear and tear is expected

  • All maintenance and repairs must be handled exclusively by Liberty Care Mobility Inc.

  • Renters may not repair or modify equipment under any circumstances

  • Damage beyond normal wear will be charged to the credit card on file


8️⃣ Equipment Acceptance

  • Renter must inspect equipment upon receipt

  • Any issues must be reported within 2 days of delivery

  • Failure to report issues within this timeframe constitutes acceptance of the equipment in good working condition


9️⃣ Warranty

Liberty Care Mobility Inc. warrants that equipment is in good working order at the start of the rental period.
No additional express or implied warranties apply.


🔟 Risk of Loss or Damage

The renter assumes full responsibility for loss, theft, or damage to the equipment for the duration of the rental.

  • The renter agrees to repair or replace damaged or lost equipment at their expense


1️⃣1️⃣ Liability & Indemnification

The renter assumes all responsibility for injuries, damages, or losses arising from the use of rented equipment and agrees to indemnify and hold Liberty Care Mobility Inc. harmless from all related claims.


1️⃣2️⃣ Default Conditions

The renter will be considered in default if any of the following occur:

  • Failure to pay rental fees

  • Violation of agreement terms not remedied within 15 days

  • Bankruptcy or insolvency

  • Legal seizure, lien, or attachment of renter’s assets


1️⃣3️⃣ Remedies Upon Default

In the event of default, Liberty Care Mobility Inc. reserves the right to:

  • Repossess equipment without prior notice

  • Charge recovery, repair, and replacement costs

  • Pursue additional legal remedies as permitted by law


1️⃣4️⃣ Notices

All notices under this Agreement are deemed delivered when mailed or personally delivered to the address listed on the rental invoice or agreement.


1️⃣5️⃣ Entire Agreement

This Agreement represents the entire understanding between the renter and Liberty Care Mobility Inc.
Any amendments must be in writing and signed by both parties.


🧼 Damage & Cleaning Fee Schedule

Rented equipment must be returned in clean, sanitary, and functional condition, allowing for normal wear and tear. Equipment returned with excessive wear, damage, or contamination may be subject to cleaning, repair, or replacement fees.

All applicable fees will be charged to the credit card on file.


🧽 Cleaning & Sanitation Fees

(Applied when equipment requires cleaning beyond standard turnaround)

  • Light cleaning (dust, minor dirt): $50 – $75

  • Heavy cleaning (bodily fluids, strong odors, pet hair, excessive dirt): $100 – $250

  • Biohazard-level cleaning (urine, feces, blood, or other bodily fluids): $250 – $500+

  • Mattress or cushion contamination requiring disposal: Full replacement cost


🔧 Damage Fees (Beyond Normal Wear & Tear)

  • Scratches, dents, or cosmetic damage affecting resale: $75 – $300

  • Torn upholstery, ripped covers, damaged padding: $150 – $600

  • Bent frames, broken welds, or structural damage: Up to full replacement cost

  • Missing or damaged accessories (rails, remotes, chargers, slings, controllers): Replacement cost

  • Electrical or mechanical damage due to misuse or unauthorized repair: Repair or replacement cost


⚡ Powered Equipment (If Applicable)

  • Battery damage or failure due to neglect or improper charging: Replacement cost

  • Control damage from liquid exposure or impact: Repair or replacement cost

  • Missing chargers or cables: Replacement cost


🚫 Unauthorized Modifications

Any unauthorized alteration, modification, or attempted repair will result in:

  • Immediate termination of the rental agreement

  • Assessment of repair or replacement costs

  • Possible forfeiture of rental payments


📦 Missing or Incomplete Returns

  • Equipment returned missing components or accessories will be charged at full replacement value

  • Equipment not returned after rental termination may be deemed lost, and full replacement cost will apply


⚠️ Final Notes

  • Fees are assessed based on inspection at return

  • Photos and documentation may be taken for records

  • Normal wear and tear does not include damage caused by misuse, neglect, pets, moisture, or contamination
